The special court has sentenced former President Pervez Mushharraf to death in the high treason case through majority verdict.
A three member special court announced its short order sentencing the former president General Musharraf to death for suspending the constitution on November 3, 2007.
The court headed by Chief Justice Peshawar High Court Waqar Ahmed Seth and comprising justice Nazar Akbar of the Sindh High court and justice Shahid Karim of the Lahore high court, issued the verdict with one member writing a dissenting note.
The detailed judgment will be issued in 2 days.
Pervez Musharraf’s long drawn treason case under article 6 began in 2013, the special court indicted the former president on 31st march 2014. During this period, the special court was reconstituted 6 times.
The verdict has been announced in the absence of Pervez Musharraf who was declared an absconder in june 2016.
Musharraf is currently hospitalized in Dubai. He has the right to appeal against the judgment.
On the other hand, the Lahore high court today took up Musharraf’s petition against the special court hearing the high treason case against him as well as his civil miscellaneous applications that urged the high court to halt the treason proceedings.
Earlier, the Islamabad high court directed the special court to not issue the verdict in the treason case against Pervez Musharraf.
Where DG ISPR has said that any ex-army Chief can never be a traitor the decision given by special court about General Pervez Musharraf retired has been received with lot of pain and anguish by rank and file Pakistan Armed Forces.
A press release issued by ISPR said, an ex-army chief, chair joint chiefs of staff committee and president of Pakistan who has served country for over 40 years, fought wars for the defence of the country can surely never be a traitor.
It says, the due legal process seems to have been ignored including constitution of special court, denial of fundamental right of self defence undertaking individual specific proceedings and concluding the case in haste.
Armed Forces of Pakistan expect that justice will be dispensed in line with constitution of Pakistan.
